Terms of Service

1. Acceptance of terms

By creating an account or using AdStack (the "Service"), you agree to these Terms of Service. If you are using AdStack on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of service

AdStack is a multi-platform advertising analytics, reporting, and ad creation platform for marketing agencies. The Service connects to third-party ad platforms via OAuth to sync campaign data, and provides tools for reporting, ad building, and client management.

3. Account registration

You must provide a valid email address and maintain the security of your account. You are responsible for all activity under your account. You must be at least 18 years old and have the legal authority to enter into this agreement.

4. Subscription and billing

AdStack is offered on a subscription basis. Plans are billed monthly. You may cancel at any time; you will retain access until the end of your current billing period. No refunds are issued for partial months. We reserve the right to change pricing with 30 days notice.

5. Free trial

New accounts receive a 14-day free trial. No credit card is required to start. At the end of the trial, you must subscribe to continue using the Service. Trial accounts that do not upgrade are automatically closed and data may be deleted after 30 days.

6. Acceptable use

You may use AdStack only for lawful advertising analytics purposes. You may not: reverse-engineer the Service; attempt unauthorized access to other accounts; use the Service to violate any ad platform's terms of service; or resell or white-label the Service without written permission from AdStack.

7. Third-party platform connections

AdStack connects to Google Ads, Meta, TikTok, LinkedIn, and StackAdapt via OAuth. Your use of those platforms is governed by their respective terms of service. AdStack is not responsible for changes to those platforms' APIs or policies that affect Service functionality.

8. Data ownership

You own all data you bring into AdStack — campaign data, client lists, reports, and platform credentials. AdStack claims no ownership over your data. You grant AdStack a limited license to process your data solely for the purpose of providing the Service.

9. Data security

AdStack employs industry-standard security measures including AES-256 encryption at rest, TLS 1.2+ in transit, row-level security for multi-tenant isolation, and SOC 2-certified infrastructure. See our Security page for full details.

10. Service availability

AdStack targets 99.9% uptime but does not guarantee uninterrupted availability. Planned maintenance will be communicated in advance. AdStack is not liable for downtime caused by third-party ad platform API outages.

11. Intellectual property

AdStack and its underlying technology, design, and branding are owned by AdStack and protected by intellectual property law. You may not copy, modify, or distribute any part of the Service without written permission.

12. Limitation of liability

To the maximum extent permitted by law, AdStack's liability for any claim arising from your use of the Service is limited to the amount you paid in the 12 months preceding the claim. AdStack is not liable for indirect, incidental, or consequential damages including lost revenue or data.

13. Termination

You may terminate your account at any time. AdStack may suspend or terminate accounts that violate these terms, with notice where reasonably practical. Upon termination, your data will be retained for 30 days before permanent deletion.

14. Changes to terms

We may update these terms from time to time. We will notify you via email at least 30 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.

15. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute will be resolved through binding arbitration under AAA rules, except for injunctive relief which may be sought in any court of competent jurisdiction.
